About these terms
These terms of service ("Terms") govern your use of the websites, products, and services ("Services") operated by ontheRISE Management Ltd ("Building Trust", "we", "us", "our"), a company registered in England and Wales.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Our Services include the Building Trust website (building-trust.uk), LEASE-iQ (AI-powered lease analysis), and BLOCK-iQ (building compliance management portal).
Eligibility and accounts
You must be at least 18 years old to use our Services. When you create an account, you must provide accurate, complete information and keep it up to date.
You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at adam.street@building-trust.uk if you suspect unauthorised access.
LEASE-iQ: AI lease analysis
LEASE-iQ uses artificial intelligence to analyse lease documents and extract key information. You acknowledge that:
- LEASE-iQ provides informational analysis only. It is not legal advice and does not replace professional legal counsel.
- While we strive for accuracy, AI analysis may contain errors, omissions, or misinterpretations. Verify findings with a qualified solicitor before acting.
- Lease documents you upload are processed securely. Our Privacy Policy explains how we handle your data.
- You must have the right to upload any document you submit. Do not upload documents you are not authorised to share.
BLOCK-iQ: compliance management
BLOCK-iQ is a compliance tracking tool for directors of residential buildings. You acknowledge that:
- BLOCK-iQ helps you track compliance obligations. It does not guarantee compliance. You remain personally responsible for your statutory duties as a director.
- Information displayed (deadlines, requirements, legislation references) is provided in good faith but may not be exhaustive. Legislation changes and you should verify current requirements.
- Data you enter about your building and residents must be accurate and collected lawfully. You are the data controller for personal data you input.
Acceptable use
You agree not to:
- use our Services for any unlawful purpose;
- upload documents you do not have authority to share;
- attempt to gain unauthorised access to our systems;
- interfere with or disrupt the performance of our Services;
- use automated means to access or scrape our Services without written consent;
- reverse engineer, decompile, or attempt to extract our source code or AI models.
Intellectual property
All content, features, and functionality of our Services are owned by Building Trust and protected by intellectual property law. You may not reproduce, distribute, or create derivative works without our prior written consent.
Documents you upload remain your property. By uploading, you grant us a limited licence to process them for the purpose of providing the Service. We do not claim ownership of your documents.
Fees and payment
Some Services are offered free of charge (for example, your first LEASE-iQ question). Others require payment. Where fees apply, they will be clearly stated before you commit. All prices are in GBP and inclusive of VAT where applicable.
Subscriptions renew automatically at the end of each billing period unless you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and we do not refund the unused portion unless required by law.
Late payment. If a payment fails, we may suspend access to paid features until the balance is settled. We will notify you before suspending access.
Price changes. We may change our pricing with at least 30 days' written notice. Price changes do not apply to any period already paid for. If you do not accept a price change, you may cancel before it takes effect.
Indemnity
You agree to indemnify and hold harmless ontheRISE Management Ltd, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with: (a) your use of the Services in breach of these Terms; (b) your breach of any law, regulation or third-party right; (c) any content you upload, post or transmit through the Services; or (d) any reliance you place on the output of LEASE-iQ or BLOCK-iQ without taking the professional advice we recommend you to take.
Service modifications and availability
We are continuously improving the Services. We reserve the right to add, modify, or discontinue any feature, content, or pricing tier at any time. Where a change materially reduces a feature you rely on as a paying user, we will give at least 30 days' notice and offer a pro-rata refund of any unused portion if you choose to cancel as a result.
The Services are provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Planned maintenance windows are notified in advance where reasonably possible.
Limitation of liability
Our Services provide information and tools to help you manage your leasehold property or building. They are not a substitute for professional legal, financial, or surveying advice.
To the fullest extent permitted by law: we are not liable for any indirect, incidental, or consequential damages; our total liability shall not exceed the greater of (i) the amount paid by you to us in the 12 months preceding the claim, or (ii) £100; we do not warrant uninterrupted or error-free service.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded under English law (including the Consumer Rights Act 2015 where you contract as a consumer).
Force majeure
Neither party is liable for failure to perform under these Terms where the failure is caused by events beyond reasonable control, including acts of God, war, terrorism, civil unrest, government action, pandemic, fire, flood, power failure, internet failure or third-party service failure (including cloud-provider outages). We will use reasonable efforts to restore Service as soon as possible.
Data protection
We take your privacy seriously. Our Privacy Policy explains what personal data we collect, how we use it, and your rights under the UK GDPR and Data Protection Act 2018.
Where you use BLOCK-iQ to process personal data about building residents, you act as data controller and must comply with applicable data protection law.
Termination
You may stop using our Services at any time. We may suspend or terminate your access if you breach these Terms or for any other reason with reasonable notice.
On termination, we will make your data available for export for a reasonable period. After that, we may delete your data in accordance with our Privacy Policy.
Changes to these terms
We may update these Terms from time to time. Material changes will be notified by email or by posting a notice on our website. Continued use after changes take effect constitutes acceptance.
Governing law and disputes
These Terms are governed by the laws of England and Wales.
If a dispute arises, please contact us first at adam.street@building-trust.uk and we will try to resolve it informally within 30 days. If we cannot, the dispute is subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause prevents a consumer from bringing a claim in their local jurisdiction where mandatory consumer protection law allows.
You may also have access to alternative dispute resolution, including the European Commission online dispute resolution platform if you contracted with us as a consumer; we are not currently signed up to a specific ADR scheme but will engage in good faith with any reasonable ADR proposal.
